SYNDICAL FREEDOM IN NEXANS PERU REALITY OR IDEAL?

Freedom of association is a fundamental right of Workers to make a interest group to participate in the management of productive relations of the company. 
That this law to be understood as such should include, at least, freedom to form unions, organize and join them, as well as adequate protection for the exercise of union activity. 

Freedom of association is made up of all the rights possessed by workers to form and join organizations that they deem appropriate, without prior permission from any authority or their employer, and the development of union activity. In this sense, positive individual freedom of association contains the following rights: 

The article 2 of ILO Convention No. 87 provides that workers and employers, without distinction whatsoever without permission, have the right to establish organizations of their own choosing, being understood by them to any organization of workers or employers for purpose promote and defend the interests of workers or employers. 
In relation to this, Article 2 of the LRCT 25,593 provides that the right to organize is free exercise by workers, without requiring prior authorization from your employer or any state authority to carry out the actions necessary for the establishment of trade unions aimed at the study, development, protection and defense of their rights and interests and the social, economic and moral of its members. 


Furthermore, Article 2 of the ILO Convention No. 98 states that workers and employers organizations shall enjoy adequate protection against acts of interference by each of the others and takes place directly or through its agents or members in the process of its formation. It also means acts of interference that measures designed to promote the establishment of organizations of workers directed or influenced indirectly by an employer or labor organization. 

In this regard, Article 4 ° of our LRCT 25593, provides that the State, employers and their representatives must refrain from any act intended to limiting, restricting or impairing in any way the right to unionize workers and also are prohibited from participating in the establishment of trade unions. 

Free Law Affiliation: 

The ILO Convention No. 87 stipulates in article 2 that workers and employers, without distinction whatsoever without permission, have the right to join unions, with the sole condition that the rules of the same. Also, complementing Amends article 1 of ILO Convention No. 98 stipulates that workers shall enjoy adequate protection against acts of discrimination tending to undermine freedom of association in respect of their employment, understanding that such protection should exercised particularly against acts intended to: 

a) Hold the employment of a worker on the condition that he shall not join a union or to cease to be a union member. 

b) Firing an employee or otherwise harm because of their union membership or participation in union activities outside working hours or, with the consent of the employer, within working hours. 

In our legal system, Article 3 of the LRCT 25593 provides that workers are entitled to choose freely and voluntarily, if they wish to join a union, no decision can be conditioned by the threat of losing their jobs or suffer any retaliation during the employment relationship. This is complemented by the provisions of paragraph a) of Article 29 ° of the TUO Legislative Decree No. 728, Law on Labor Productivity, approved by Supreme Decree 003-97-T, revokes the dismissal on grounds that have a union affiliation or participation in union activities. 

As we can see, freedom is 
universally established, 
despite  usually in Peru 
do not respect it, 
such is our case

For example: 

Trade Union is not included in Job evaluation: workers must participate in a Job Evaluation Committee and Categorization because is important that the Company fully recognizes our contribution in the production process, according to the ability of each employee, without discrimination. 

Trade Union is not included in WORKING MANUAL (Rules of actions of workers) elaboration: the management write a "worker´s regulation code" without participation of the Union in its development and PERUVIAN GOVERNMENT (Secretary of Labour) has observed it, because broke the rules of peruvian law.

LIBERTAD SINDICAL EN INDECO REALIDAD O IDEAL ? /SYNDICAL FREEDOM IN INDECO REALITY OR IDEAL?

La libertad sindical es el derecho fundamental
de los trabajadores a agruparse establemente para participar en la ordenación de las relaciones productivas
Que este derecho, para ser entendido como tal, debe incluir, por lo menos, la libertad para constituir sindicatos, organizarlos y afiliarse a ellos, así como la adecuada protección al ejercicio de la actividad sindical.

La libertad sindical esta constituido por todos los derechos que poseen los trabajadores para constituir y afiliarse a las organizaciones que consideren convenientes, sin autorización previa de ninguna autoridad o de su empleador, así como el desarrollo de la actividad sindical. En tal sentido, la libertad sindical individual positiva contiene los siguientes derechos:

El artículo 2° del Convenio OIT Nº 87 establece que los trabajadores y empleadores, sin ninguna distinción y sin autorización previa, tienen el derecho a constituir las organizaciones que estimen convenientes, debiendo entenderse por éstas a toda organización de trabajadores o empleadores que tenga por objeto fomentar y defender los intereses de los trabajadores o de los empleadores.
En relación a ello, el artículo 2° de la LRCT 25593 establece que el derecho a la sindicación es de libre ejercicio por parte de los trabajadores, sin que sea necesaria la autorización previa de su empleador o de alguna autoridad estatal para llevar a cabo las acciones necesarias para la creación de organizaciones sindicales que tengan por objeto el estudio, desarrollo, protección y defensa de sus derechos e intereses y el mejoramiento social, económico y moral de sus miembros.


Por otra parte, el artículo 2° del

Convenio OIT N° 98


señala que las organizaciones de trabajadores y empleadores deberán gozar de adecuada protección contra todo acto de injerencia de unas respecto de las otras, ya se realice directamente o por medio de sus agentes o miembros, en el proceso de su constitución. Asimismo, entiende por actos de injerencia las medidas que tiendan a fomentar la constitución de organizaciones de trabajadores dirigidas indirectamente o influenciadas por un empleador o una organización de trabajadores.

Al respecto, el artículo 4° de nuestra LRCT 25593, dispone que el Estado, los empleadores y sus representantes deberán abstenerse de realizar cualquier acto que tenga por objeto coactar, restringir o menoscabar, en cualquier forma, el derecho a la sindicalización de los trabajadores y, además, se encuentran prohibidos de participar en la creación de organizaciones sindicales.

Derecho de Libre Afiliación:

El Convenio OIT N° 87 dispone en su artículo 2° que los trabajadores y empleadores, sin ninguna distinción y sin autorización previa, tienen el derecho de afiliarse a las organizaciones sindicales, con la sola condición de observar los estatutos de las mismas. Asimismo, complementando la libertad de afiliación, el artículo 1° del Convenio OIT N° 98 establece que los trabajadores deberán gozar de una adecuada protección contra todo acto de discriminación tendiente a menoscabar la libertad sindical en relación con su empleo, entendiendo que dicha protección deberá ejercerse especialmente contra todo acto que tenga por objeto:

a) Sujetar el empleo de un trabajador a la condición de que no se afilie a un sindicato o a la de dejar de ser miembro de un sindicato.

b) Despedir a un trabajador o perjudicarlo en cualquier otra forma a causa de su afiliación sindical o de su participación en actividades sindicales fuera de las horas de trabajo o, con el consentimiento del empleador, durante las horas de trabajo.

En nuestro ordenamiento jurídico, el artículo 3° de la LRCT 25593, establece que los trabajadores tienen derecho a elegir, libre y voluntariamente, si desean afiliarse a un sindicato, no pudiendo estar condicionada su decisión por la amenaza de perder su empleo o sufrir cualquier tipo de represalia durante la relación laboral. Ello se ve complementado con lo previsto en el inciso a) del artículo 29° del T.U.O. del Decreto Legislativo N° 728, Ley de Productividad y competitividad Laboral, aprobado por el Decreto Supremo N° 003-97-TR, establece la nulidad del despido que tenga por motivo la afiliación a un sindicato o la participación en actividades sindicales.

Como podemos apreciar, LA LIBERTAD SINDICAL esta instituido universalmente, generalmente en el Perú a pesar de existir una normatividad clara, los empresarios no respetan, tal es el caso nuestro donde Indeco s.a., viene eludiendo la aceptación plena a los trabajadores organizados, en diferentes aspectos, por ejemplo:

EVALUACION DE PUESTOS, los trabajadores debemos participar en un Comité de Evaluación de Puestos y Categorización, es de vital importancia que la Empresa reconozca plenamente nuestro aporte en el proceso productivo, de acuerdo a la capacidad de cada trabajador, sin discriminaciones .

REGLAMENTO INTERNO DE TRABAJO (RIT), La Empresa ante la gestión sindical permanente, , entregó un reglamento sin participación del SINDICATO en su elaboración que el MINTRA lo ha observado, nuestro sindicato de acuerdo a normas legales también realizará las observaciones pertinentes acerca del RIT.
